Legal contract

These Terms of Use (“Terms”) constitute a legal contract between you and Voyza (“Voyza,” “we,” or “us”). By using Voyza’s website at voyza.ai (the “Site”), you agree to these Terms and our separate Privacy Policy.

You understand and agree that Voyza is a third-party platform that provides travel booking services. Voyza is not a hotel, and by using the Site you are not necessarily booking directly with a hotel. As consideration for your agreement, you receive access to the Site, Voyza’s booking-related services, and customer support (collectively, the “Services”). You must be 18 or older and legally able to enter into this contract. The Site may contain links to third-party sites; Voyza does not control those sites and is not responsible for their content or practices.

Dispute resolution

Informal resolution. Before pursuing formal dispute resolution, please contact us at legal@voyza.ai so we can try to resolve the issue.

Arbitration. Except where prohibited by law, you and Voyza agree that any dispute arising out of or relating to these Terms, the Privacy Policy, or the Services will be resolved by binding arbitration administered under applicable arbitration rules, rather than in court, except that either party may seek injunctive relief in a court of competent jurisdiction. You and Voyza agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any class or representative proceeding. If this class-action waiver is held unenforceable, then the parties’ agreement to arbitrate shall be null and void to that extent.

Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where preempted by federal law.

Third-party beneficiaries

To provide the Services, Voyza may use third-party platforms, payment processors, and hotel inventory providers (“Vendors”). Certain provisions of these Terms that relate to disclaimers, limitations of liability, and indemnity may also benefit Vendors and Voyza’s service providers as intended third-party beneficiaries, to the extent permitted by law.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, VOYZA DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” VOYZA DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT THE SITE IS FREE OF HARMFUL COMPONENTS. VOYZA DOES NOT GUARANTEE THE LOWEST PRICE, AVAILABILITY, OR ACCURACY OF ALL LISTINGS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Limitations of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VOYZA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES. HOTELS AND OTHER PROVIDERS ARE INDEPENDENT CONTRACTORS; VOYZA IS NOT LIABLE FOR THEIR ACTS, ERRORS, OR OMISSIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Authorization of charges; fees and taxes

You authorize Voyza and its partners to book reservations for the price shown, plus applicable fees and taxes. Rates may include service or processing fees disclosed before purchase. Some fees may be non-refundable as stated at checkout or in your confirmation. You are responsible for hotel-imposed charges (e.g., resort fees, parking, incidentals) unless otherwise stated.

Quoted pricing and provider terms

Prices are subject to change until a booking is confirmed. Voyza may correct pricing errors; if a booking cannot be honored at the displayed price, we may offer the correct price or cancel without penalty where required. Each property may impose additional terms (cancellation, identification at check-in, health and safety). You agree to comply with those terms.

Cancellations and changes

Cancellation and change policies are set by the hotel or provider and are shown before you book and in your confirmation. Fees may apply. Voyza does not guarantee refunds except as required by law or the applicable fare rules. Voyza is not responsible for delays, overbooking, or events outside its reasonable control.

International transactions

Bookings may be processed in U.S. dollars or as shown at checkout. Your bank may charge foreign transaction or currency conversion fees. You are responsible for passports, visas, and entry requirements.

Accounts

If you create an account, you agree to provide accurate information and keep credentials secure. We may suspend or terminate accounts for fraud or violation of these Terms.

Acceptable use

You agree not to misuse the Site: no fraudulent bookings, no scraping or excessive automated access without permission, no interference with the Services, and no violation of applicable law.

Communications

By providing contact information, you agree that Voyza may send transactional messages about your bookings. Where you opt in, we may send marketing messages; you can opt out as described in those messages or in our Privacy Policy.

Intellectual property

Content on the Site is owned by Voyza or its licensors. You may not copy, modify, or redistribute Site content except as allowed for your personal use of the Services.

Indemnity

You agree to indemnify and hold harmless Voyza and its affiliates, officers, directors, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your bookings, or your violation of these Terms.

DMCA

If you believe content on the Site infringes your copyright, send a notice to legal@voyza.ai with the information required under the DMCA, including a description of the work, the URL of the material, your contact information, and statements of good faith and accuracy.

Changes to these Terms

Voyza may modify these Terms by posting an updated version on the Site. If you do not agree, you should stop using the Services. Continued use after the effective date may constitute acceptance.
